Most solicitors appreciate proving liability is half the equation and assessing quantum the other. What is the use of obtaining judgement if it cannot be enforced because the defendant has no assets to satisfy the judgement debt?

As a solicitor and chartered accountant, Troy understands the legal principles and accounting methodologies to employ when proving liability and quantifying damages. He has provided expert accounting evidence in a broad range of disputes in the Supreme Courts of New South Wales and Victoria as well as the Federal Court of Australia. He understands the rules of evidence and knows that different legal principles and accounting methodologies are applied depending upon whether the dispute is grounded in contract, tort or equity.

He may be retained as a consulting or independent accounting expert. If the later Troy will prepare and provide his evidence in accordance with each court's Expert Code of Conduct, and the ICAA's APS 11 - Statement of Forensic Accounting Standards and Guidance Note N8.

One cannot over-emphasise the importance of retaining an experienced accounting expert. Many reports end up being worth little more than the paper they are written on.

  • loss of profit reports in contractual disputes
  • economic loss reports in negligence disputes
  • account of profit reports in equity and intellectual property disputes
  • damages reports in trade practices matters
  • business interruption reports in insurance claims
  • forensic investigations - existence of evidence to prove or rebut liability

  • formulating subpoenas or notices to produce
